1. Who we are

This website, www.swissquantumfinance.com (the "Website"), is operated by Swiss Quantum Finance AG ("SQF", "we", "us", "our"), a company incorporated under the laws of Switzerland, registered in the Swiss Commercial Register under number CHE-380.703.618, with its registered office at Rue Robert-Céard 6, 1204 Geneva, Switzerland.

SQF is a financial intermediary within the meaning of Article 2 paragraph 3 of the Swiss Anti-Money Laundering Act (AMLA), affiliated with SO-FIT (Organisme de Surveillance pour Intermédiaires Financiers & Trustees), a self-regulatory organisation recognised by the Swiss Financial Market Supervisory Authority (FINMA). 2. Scope of these Terms

These Terms of Use govern your access to and use of the Website, including the informational pages, the contact and application forms, and your access to the SQF client portal login pages.

These Terms do not govern the financial services SQF provides to its clients. Those services are governed exclusively by the SQF Financial Services Agreement, the applicable Fee Appendix and the other onboarding documents accepted by the client during the account-opening process. If there is any conflict between these Terms and the Financial Services Agreement, the Financial Services Agreement prevails in respect of the services.

By accessing or using the Website you agree to these Terms. If you do not agree, do not use the Website.

3. No offer, no advice

The content of this Website is provided for general information purposes only. It does not constitute, and must not be construed as:

an offer, solicitation or recommendation to buy or sell any financial instrument or digital asset;
legal, tax, accounting, investment or other professional advice; or
a commitment by SQF to open an account, execute a transaction or provide any service to any person.

All accounts, services, payment capabilities, FX execution and digital asset services described on this Website are subject to SQF's compliance review and internal approval. No client relationship is established, and no account, payment, wallet or transaction capability is confirmed, until SQF's onboarding and compliance review has been completed and approved and a written agreement has been entered into.

Indicative pricing, fees or service descriptions shown on the Website are non-binding and may change without notice. The fees applicable to a client are those agreed in that client's Fee Appendix.

4. Eligibility and intended audience

The Website and SQF's services are directed at businesses and corporate users. SQF's services are not offered to consumers acting for personal, family or household purposes.

The information on this Website is not directed at, and is not intended for distribution to or use by, any person in any jurisdiction where such distribution or use would be contrary to local law or regulation, or would subject SQF to any registration or licensing requirement in that jurisdiction. It is your responsibility to inform yourself about and observe all applicable laws in your jurisdiction.

5. Client portal access

Parts of the Website provide access to the SQF client portal. Use of the portal is reserved for persons who have been issued credentials by SQF or invited through an SQF relationship manager.

You are responsible for:

keeping your login credentials confidential and secure;
all activity that occurs under your credentials;
notifying SQF without delay at portal-support@swissquantumfinance.com if you suspect any unauthorised access to or use of your account.

SQF may suspend or withdraw portal access at any time where it reasonably believes this is necessary for security, legal or regulatory reasons, or where these Terms or the Financial Services Agreement are breached.

6. Acceptable use

You agree not to:

use the Website for any unlawful purpose or in breach of any applicable law or regulation;
attempt to gain unauthorised access to the Website, the client portal, the servers on which they are hosted, or any connected system;
introduce viruses, malware or other harmful material;
scrape, harvest or collect data from the Website by automated means without our prior written consent;
interfere with or disrupt the integrity or performance of the Website;
impersonate any person or misrepresent your affiliation with any person or entity; or
submit false, inaccurate or misleading information through any form on the Website.

7. Intellectual property

The Website and its content — including text, graphics, logos, the SQF name and brand, page layouts, and software — are owned by or licensed to SQF and are protected by Swiss and international intellectual-property laws.

You may view, download and print content from the Website for your own internal business evaluation purposes, provided you keep all proprietary notices intact. Any other reproduction, distribution, modification or re-publication without SQF's prior written consent is prohibited.

8. Third-party links and content

The Website may contain links to third-party websites or services. These links are provided for convenience only. SQF does not control and is not responsible for the content, security or privacy practices of third-party sites, and a link does not imply endorsement.

9. No warranty

The Website is provided on an "as is" and "as available" basis. While SQF takes reasonable care to keep the content of the Website accurate and up to date, SQF makes no representation or warranty, express or implied, as to the accuracy, completeness or timeliness of any content, or that the Website will be uninterrupted, error-free or free of viruses or other harmful components.

10. Limitation of liability

To the fullest extent permitted by law, SQF excludes all liability for any loss or damage — direct, indirect or consequential — arising from your use of, or inability to use, the Website or its content.

Nothing in these Terms excludes or limits SQF's liability for unlawful intent or gross negligence, or any other liability that cannot be excluded or limited under Swiss law.

For the avoidance of doubt, the liability regime applicable to the financial services SQF provides to its clients is set out in the Financial Services Agreement, not in these Terms.

11. Data protection and cookies

SQF processes personal data collected through the Website in accordance with the Privacy Policy, which also explains our use of cookies and similar technologies. You can adjust non-essential cookies at any time via the "Cookie preferences" link in the footer.

12. Changes to the Website and these Terms

SQF may modify, suspend or discontinue any part of the Website at any time. SQF may amend these Terms from time to time. The version published on this page is the version in force; material changes will be indicated by updating the effective date above. Your continued use of the Website after a change constitutes acceptance of the amended Terms.

13. Languages

These Terms and the other legal pages on this Website are published in English and French. The translations are provided for convenience; in the event of any divergence between the language versions, the English version prevails.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

15. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with the Website or its content, are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules. The exclusive place of jurisdiction is Geneva, Switzerland, subject to any mandatory places of jurisdiction provided by law.
